All Pelican Outdoor Products offer a limited warranty period from when the product is purchased in new condition on the Pelican Outdoor website (PELICANOUTDOOR.COM) or from an authorized seller.

Case-Mate, Inc. (“Pelican Outdoor”) guarantees to the original purchaser of its products from pelicanoutdoor.com or an authorized reseller that its products will be free from breakage or defects in materials and workmanship from the date of purchase for the applicable period set forth above. To the extent permitted by law, Case-Mate, Inc.’s liability is limited to the product and in no event shall Case-Mate, Inc.’s liability to the purchaser for damages exceed the purchase price of the product in respect of which damages are claimed.

TO THE EXTENT PERMITTED BY LAW: (A) THIS WARRANTY IS IN LIEU OF ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE; (B) ALL OTHER IMPLIED WARRANTIES AND ANY LIABILITY NOT BASED UPON CONTRACT ARE HEREBY DISCLAIMED AND EXCLUDED; AND (C) IN NO EVENT SHALL CASE-MATE, INC. BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR SPECIAL DAMAGES, REGARDLESS OF WHETHER A CLAIM FOR SUCH DAMAGES IS BASED ON WARRANTY, CONTRACT, NEGLIGENCE OR OTHERWISE.

Case-Mate, Inc. will either repair or replace any broken or defective product, at our sole option. Certain products are available for a limited time only. If a claim is made involving one of these products, Case-Mate, Inc. reserves the right to replace a broken or defective product with a standard Case-Mate, Inc. product of comparable size and quality if no comparable limited edition product is available at the time of a claim. TO THE EXTENT PERMITTED BY LAW, THIS SHALL BE THE SOLE AND EXCLUSIVE REMEDY OF THE PURCHASER.

To make a warranty claim, the purchaser must complete the warranty claim form at https://support.pelicanoutdoor.com/hc/en-us/requests/new. Any warranty claims shall be made by the purchaser as soon as practicable but in no event later than the expiration of the applicable warranty period and proof of purchase is required. The purchaser must obtain a return authorization number from Case-Mate, Inc. Customer Service prior to returning any product, and is responsible for paying for all warranty freight costs. If Case-Mate, Inc. determines that any returned product is not defective, within the terms of this warranty, the purchaser shall pay Case-Mate, Inc. all costs of handling, return freight and repairs at Case-Mate, Inc.’s prevailing rates.

All warranty claims of any nature are barred if the product has been altered, damaged or in any way physically changed, or subjected to abuse, misuse, negligence or accident.

Some states and countries do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may have other rights which vary from state to state and country to country.

In Australia: The benefits provided to you under this warranty are in addition to your rights and remedies as a consumer under the Australian Consumer Law as contained in the Competition and Consumer Act 2010 (Cth) (“the Act”). Nothing in this warranty limits the rights or obligations of a party under the Act in relation to the supply to consumers of goods which cannot be limited, modified or excluded. If applicable, our goods come with guarantees that cannot be excluded under the Act. Consumers are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. Consumers are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. If you are not a consumer under the Act, then your rights may be limited. To make a warranty claim, the purchaser may contact Case-Mate, Inc. 115 Perimeter Center Pl, Atlanta, GA 30346 USA, or email: pelicanoutdoor@cmbrands.com. Any claims should be made as soon as practicable. To expedite claims, the purchaser should obtain a return authorization number from Case-Mate, Inc. Customer Service prior to returning any product. The purchaser is responsible for paying for all freight costs. If Case-Mate, Inc. determines that any returned product is not defective, within the terms of this warranty or the Act, the purchaser may pay Case-Mate, Inc. all costs of handling, return freight and repairs at Pelican’s prevailing rates. In the event that Case-Mate, Inc. determines that any returned product is defective, within the terms of this warranty or the Act, Case-Mate, Inc. shall pay the purchaser all reasonable costs of the purchaser in making a claim under this warranty.

REQUIREMENTS

We take pride in the products we make and warrant to the person who originally purchased the product (“you”) that all Pelican Outdoor products will be free from defects in workmanship and materials for their applicable Warranty Period, subject to the below conditions.

In order for your warranty claim to be approved, the following must be met:
  • You must have used the product only as intended and in accordance with the product's case instructions.
  • You must have purchased the product from a www.pelicanoutdoor.com, or a Pelican Outdoor authorized dealer;
  • If you purchased the item(s) from www.pelicanoutdoor.com, you can file a warranty claim here: https://support.pelicanoutdoor.com/hc/en-us/requests/new
  • You must provide proof as to the date of purchase from the Pelican Outdoor authorized dealer;
  • If you purchased the item(s) from an authorized reseller and the product is defective, please check the reseller's return or exchange policy before filing a warranty claim. Products purchased from an authorized re- seller must be returned to the original place of purchase within the store’s return period for a return or exchange. If you are unable to obtain an exchange or refund, you may file a warranty claim with Pelican Outdoor. Proof of purchase is required showing that the item was purchased in new condition. Pelican Outdoor is unable to offer any refunds for a product not purchased on the Pelican Outdoor website (PELICANOUTDOOR.COM).   • You must return the product to Pelican Outdoor for all warranty claims if such claim is processed by PELICANOUTDOOR.COM
If a defect occurs as the result of the Product’s intended use according to the care instructions during the Warranty Period, we will repair or replace, at our discretion, the defective product or part.
The warranty does not cover defects caused by third-party modifications, repairs, or replacement parts. Punctures, scratches, normal wear and tear, and the natural breakdown of colors and materials over extended time and use are not approved for warranty.

LIMITATIONS ON WARRANTY

Our guarantee does not cover product damages that may have resulted from normal wear and tear or misuse/abuse or modification of the product. Additionally, the warranty does not cover damage to your device as a result of the use of any Pelican Outdoor product. Our warranty policy does not cover lost or stolen items.

To the maximum extent permitted by law, Pelican Outdoor is not responsible for direct, or for special, incidental or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including without limitation any costs of replacing personal property, or costs of recovering or reproducing any program or data stored in a device used with or carried in the incase product.

This warranty gives you specific legal rights, and you may have other rights which vary from state to state and country to country.

WARRANTY REPLACEMENT

If a defect arises and a valid claim is received by Pelican Outdoor, we will, at our discretion, replace any product that proves to be defective in material or workmanship with a functionally equivalent new product. Pelican Outdoor reserves the right to send a replacement product of similar value and design. 

Warranty replacements are provided based on product availability. If your product is no longer being manufactured or is out of stock, we may replace your product with a similar or better product at our option.

 

CLAIM DOCUMENTATION

Proof of purchase, along with a photo of the damaged item, is required to file a warranty claim. On all warranty claims, Pelican Outdoor reserves the right to decline a warranty for insufficient documentation or for product defects that are not verifiable. We also reserve the right to request the item be returned to Pelican Outdoor for inspection.c

SHIPPING

On all warranty replacements, the customer is responsible for shipping charges to ship the defective product to Pelican Outdoor.

OBTAINING WARRANTY SERVICE

If you wish to make a claim under this warranty with respect to a Pelican Outdoor product, please SUBMIT A REQUEST online.

CONSUMER PROTECTION

For consumers who have the benefit of consumer protection laws or regulations in their country of purchase or, if different, their country of residence, that cannot be disclaimed as set forth above ("consumer laws"), the benefits conferred by this warranty are in addition to all rights and remedies conveyed by such consumer laws. To the extent that liability under such consumer laws may be limited, Pelican Outdoor liability is limited, at its sole option, to provide replacement or repair of the product.
